There is no link between outstanding etoll bills and renewal of vehicle licenses

If you are one of the many drivers who hasn’t been paying your etolls, we have a bit of good news for you.

Earlier this week, the Justice Project South Africa (JPSA) said that the Department of Transport has published proposed amendments to the National Road Traffic Regulations that make it legal to withhold a vehicle license disc if the driver has outstanding etolls.

But it seems as though drivers who refuse to pay etolls received a bit of a reprieve in the legislation being pushed through – for now.

The issue of withholding discs was first mentioned when the new dispensations were announced a couple of months ago, but Notice No. R. 607 in government gazette 38997, published for comments on Friday July 17th, 2015 refers to ‘regulation 11 of the e-Road Regulations, 2015′.

According to JPSA and Opposition to Urban Tolling Alliance (Outa), Regulation 11 doesn’t exist, and there is currently no link between outstanding e-toll bills and the renewal of vehicle licenses.

“For now, we are pleased the Gazette will have to be amended, which means that there is currently no link between outstanding e-toll bills and the renewal of vehicle licenses. However, as and when the authorities do attempt to regulate e-toll payments through the renewal of vehicle license discs or any other methodology, OUTA(sic) will challenge these irrational decisions and provide motorists with advice and input on how to deal with this strategy by Government,” Outa said in a statement.

Wayne Duvenage, Chairperson of Outa said that this once again proves that Sanral and the Department of Transport can’t get things right.

“We find it rather absurd that once again, SANRAL and the Department of Transport cannot get their act together, when trying to amend legislation to force the unjust e-toll scheme into being,” he said.
