Hlaudi still employed at the SABC, says his lawyer

Hlaudi Motsoeneng’s lawyer, Zola Majavu, says his client remains an employee of the SABC.

This follows the ruling delivered by the Western Cape Court judgement yesterday on Motsoeneng’s appointment as GE of Corporate Affairs and the disciplinary hearing held on his previous appointment as COO.

The court ruled that the recent appointment was unlawful and that the hearing had not followed due processes and had to be re-instituted.

Speaking on SAfm’s morning show today, Majavu said the judgement doesn’t state that Motsoeneng is no longer an employee of the SABC [the court ruled he couldn’t hold any position at the public broadcaster pending a review of the Public Protector report which had recommended the hearing be held], but he however advised him not to arrive at work, until he’s received clarity on his exact status at the SABC.

Majavu disputed reports that the ruling determined that Motsoeneng’s employment has been terminated, adding that it’s up to the SABC to decide whether or not to fire him and that he’d be within his rights to return to work today, should he decide to do so.

“This is one of the things where the law doesn’t necessarily provide you with answers. People think it’s as simple as that, but obviously, anybody who is affected by this, including Mr Motsoeneng, may appeal if they so wish, so can the SABC, so can the minister [of Communications, Faith Muthambi] but at the moment, it’s still early days,” Majavu said.
