South Africa’s first online piracy case delayed

The first criminal trial for uploading a video file to the internet to take place in South Africa has been delayed, after it was referred to a different court ahead of a scheduled hearing this morning.

The prosecution of a Mr M Norton, from the Cape Flats, was due to be heard today in Athlone magistrates court. Norton is accused of uploading an as-yet undisclosed TV series to a file sharing website, ahead of its commercial release. Norton’s first hearing was held on 13th December, when he was released on bail of R1 000.

The initial charge sheet against Norton cited claims of R126 000 loss of revenue. He was originally charged for contravention of the Counterfeit Goods Act, although it’s believed more charges will be brought before the next hearing.

Norton’s case has been transferred to the Special Commercial Crimes Court in Bellville. The next hearing is scheduled for 26th February.
