Court rules appointment of SABC COO was unlawful

The permanent appointment of Hlaudi Motsoeneng as SABC COO was unlawful, the Western Cape High Court has ruled this morning.

This is after the DA sought a court order last month to hold the national broadcaster in contempt of court for failing to suspend the controversial executive, even though the court had ordered he be suspended back in 2014.

The suspension came about after an investigation by Public Protector Thuli Madonsela, who found that Motsoeneng had irregularly increased his own salary three times in a single year and lied about his matric qualifications, among other issues.

An appeal by Motsoeneng brought before the Supreme Court of Appeal to overturn the ruling, had also previously failed.

“The SABC has clearly failed to [suspend Motsoeneng] which is a flagrant contempt of Court and is the latest demonstration that the ANC in government have absolutely no regard for the Rule of Law and due process,” the DA said at the time of the court order application.

The SABC and Motsoeneng are yet to comment on the matter, but it’s expected they will defend themselves against the ruling.

[UPDATE]: Just as predicted, the Minister of Communications, Faith Muthambi is reportedly planning to appeal the court’s judgement. Muthmabi was also part of the the failed appeal at the Supreme Court Appeal]
