Who should replace Thuli Madonsela? You can nominate SA’s next Public Protector

Think you know someone who could do as great a job of being South Africa’s Public Protector as Advocate Thuli Madonsela has done during her term? You have the chance to send your nomination in.

The Ad Hoc Committee to Nominate a Person for Appointment as Public Protector, comprising various political and legal stakeholders, has opened up public nominations and applications for the position of Public Protector.

Madonsela’s term comes to end this September and thereafter, a newly-elected candidate will take over.

Ultimately, the president of South Africa appoints the Public Protector upon recommendation of the Ad Hoc Committee.

To be the Public Protector, a candidate must fit any of the following criteria:

  • is a Judge of a High Court
  • is admitted as an advocate or an attorney and has, for a cumulative period of at least 10 years after having been so admitted, practised as an advocate or an attorney
  • is qualified to be admitted as an advocate or an attorney and has, for a cumulative period of at least 10 years after having so qualified, lectured in law at a university
  • has specialised knowledge of or experience, for a cumulative period of at least 10 years, in the administration of justice, public administration or public finance
  • has, for a cumulative period of at least 10 years, been a member of Parliament
  • has acquired any combination of experience mentioned in the above, for a cumulative period of at least 10 years

Nominations must contain a detailed CV and contact details of the person or organisation making the nomination and a signed acceptance of the nomination by the nominee.

Applications/nominations must reach Vhonani Ramaano, Committee Secretary at the following address by no later than 24th June 2016 at 4pm:

Committee Chairperson, Dr Makhosi Khoza, said the committee will publish a list of nominees and applicants for the public to comment on.

“Soliciting views from the public is in keeping with our Constitutional obligation, hence our unanimous decision to allow members of the public an opportunity to make their comments or objections on whether a particular name is fit and proper to be considered for the position of the Public Protector, ” Khoza said.

Public comments will be allowed from 27th June to 1st July on a yet-to-be-announced platform.

“After the public participation process, the Committee will convene for short listing during the week of 11 to 15 July 2016 with interviews expected to be held on 10th August 2016,” the committee said.

The final nominee will have to be supported by more than 60% of the National Assembly before President Jacob Zuma can make a decision.
