Ford “has failed to comply with the law” say police

Ford’s reluctance to issue a safety recall of the Ford Kuga may come back to haunt it as police accuse the manufacturer of breaking the law.

The allegation has been made by legal officer in the Western Cape provincial police commissioner’s office, Colonel Rozelle Kruger in an affidavit.

The crux of Kruger’s affidavit alleges that Ford did not inform the National Consumer Commission of Reshall Jimmy’s death despite its obligation to do so.

“It is clear that Ford was obliged to inform the commission of Jimmy’s death. They failed to do so. It has failed to comply with the law,” Kruger was quoted as saying by Times Live.

The colonel was responding to Ford’s urgent request to the High Court to obtain evidence contained in the police inquest docket into Reshall Jimmy’s death in December 2015.

The motor vehicle manufacturer alleges that its investigation into the death of Jimmy has been thwarted by police as well as the deceased’s family.

In an affidavit submitted this week by Constable Thembekile Matwa it has been alleged that Ford obstructed the police’s investigation into Jimmy’s death.

The vehicle manufacturer issued a recall of 4 556 Ford Kuga 1.6l Ecoboost vehicles earlier this month but with these allegations being made it appears as if Ford is not out of the woods yet.
