High court orders Brian Molefe to pay back pension payout

The High Court in Pretoria has said this morning that former Eskom chief executive officer Brian Molefe must pay back R11 million which he received as a pension payout.

This follows a case brought forward to the High Court by Solidarity in which it claimed that a pension payout to Molefe of R30 million was unlawful.

Molefe announced in 2016 that he would be stepping down from his position as CEO at Eskom. That decision came just after the release of Thuli Madonsela’s State Capture report in which Molefe featured prominently.

Then, shortly before his return to Eskom in 2017 a report by The Sunday Times revealed that Molefe had receieved a R30 million pension payout from the utility.

The High Court ruled that Molefe must pay back the R10 million plus payout he had already received as well as damages.

“Molefe acted unlawfully and in no way within the framework of Eskom’s pension and provident fund,” head of Solidarity’s Centre for Fair Labour Practices Anton van der Bijl told eNCA.

Molefe has 10 days to pay back the money.
