Elon Musk says he’s still freely tweeting after SEC settlement

Tesla founder and CEO Elon Musk has been rather quiet of late, apart from an ill-advised weed smoking incident, following his settlement with the SEC in October this year.

The same event also resulted in the Musk stepping down from his role as chairman of Tesla, with all this recent activity stemming from his antics on Twitter, and more specifically sending out messages at an almost Trump-like level.

It looks like that won’t change any time soon, with Musk recently conducting an interview with CBS’ 60 Minutes in which the Tesla founder did not hold on back on his opinion about the SEC and a few other matters.

Musk said that he did not respect the SEC, and has been tweeting without any sorting of censorship since the settlement was finalised.

While it is indeed Musk’s right to do so, he could potentially be infringing upon the stipulations of said settlement, as The Verge points out.

In particular the settlement says the following:

“comply with all mandatory procedures implemented by Tesla, Inc. (the “Company”) regarding (i) the oversight of communications relating to the Company made in any format, including, but not limited to, posts on social media (e.g. Twitter), the Company’s website (e.g. the Company’s blog), press releases, and investor calls, and (ii) the pre-approval of any such written communications that contain, or reasonably could contain, information material to the Company or its shareholders.”

As such every one of Musk’s tweets are not beholden to an overseer, but he is required to have the ones in reference to Tesla and its business operations checked before they are sent out.

Whether there is a screening process in place remains to be seen, and as such Musk going on television and stating that no one is vetting his tweets seems like an odd move as it will no doubt provoke scrutiny.

Following the 60 Minutes interview airing Stateside, Tesla issued a swift press statement in which a spokesperson noted that the company is complying with all the elements contained with the settlement agreement.

Yes, Musk is free to do as he wishes, but it seems like he’s courting fate by being so brazen in his actions.

But hey, it’s not our millions.
